Terms of Service
These terms govern your use of the Kenmore Advisor Ltd. website at kenadvisorcenter.com. The firm has tried to write them in language that a human being would actually read — while still covering the legal ground that a terms-of-service page needs to cover. If anything is unclear, contact us at contact@kenadvisorcenter.com and we'll explain it in even plainer language.
1. What This Website Is (And What It Isn't)
This website provides information about Kenmore Advisor Ltd.'s practice management and investment process consulting services. It is not a source of personalized investment advice, a solicitation to buy or sell securities, or a substitute for professional financial, legal, or tax counsel.
For example: if a page describes how Kenmore helps advisory firms build Investment Policy Statements, that's a description of a consulting service — not investment advice you should act on without professional guidance. Similarly, when the firm discusses client segmentation modeling or behavioral finance integration, these are descriptions of consulting methodologies delivered within formal engagements, not prescriptive recommendations for your practice.
The distinction matters. Kenmore Advisor Ltd. does not manage client assets, provide securities recommendations, or act in any portfolio management capacity. The firm builds the operational frameworks that advisory practices use to deliver better service — the architecture, not the investment decisions themselves. If you're looking for someone to manage a portfolio, the firm is happy to recommend qualified professionals. If you're looking for someone to redesign the process by which your team manages portfolios, you're in the right place.
2. Your Use of the Site
Basically: use the site the way a reasonable person would — to learn about our services, contact us, or access the advisor portal.
More specifically, you agree not to:
- Scrape, crawl, or data-mine this website or any of its content using automated tools, bots, or scripts — whether for commercial purposes, competitive intelligence, or because you're curious about our technology stack.
- Interfere with the site's operation — including attempts to bypass security measures, overload servers, introduce malicious code, or test vulnerabilities. If you discover a legitimate security concern, please report it to contact@kenadvisorcenter.com and the firm will address it promptly.
- Impersonate Kenmore Advisor Ltd., any of its employees, or any of its clients — in any forum, on any platform, or in any communication. This includes creating the impression that you are affiliated with the firm when you are not.
- Use the site for any unlawful purpose or in any manner that violates applicable Canadian federal, provincial, or municipal law.
Kenmore reserves the right to restrict access to any user who violates these terms — though, in ten years of operation, the firm has never needed to invoke this clause. The bar for being a welcome visitor here is remarkably low: don't break things, don't misrepresent yourself, and don't use robots where a browser works just fine.
3. Intellectual Property
All content, frameworks, methodologies, and materials on this website are © 2026 Kenmore Advisor Ltd. This includes — but is not limited to — the Practice Health Scorecard methodology, the 47-Question Discovery Framework, all client segmentation models, the Investment Process Architecture (IPA) framework, service tier definitions, behavioral finance profiling tools, crisis communication playbook structures, and the earned value management adaptations Kenmore has developed for advisory practice consulting.
You're welcome to reference our ideas in conversation — that's the point of thought leadership — but please don't reproduce our proprietary frameworks, diagnostic methodologies, or training materials without written permission. A quick email to contact@kenadvisorcenter.com is all it takes; the firm is generally quite generous with permissions for educational and non-commercial use.
The Kenmore Advisor Ltd. name, wordmark, and all associated branding elements are trademarks of the firm. Unauthorized use of these marks in a manner likely to cause confusion — including in digital advertising, social media profiles, or competitor marketing materials — is prohibited under Canadian trademark law and will be addressed accordingly.
4. The Advisor Login Portal
The login section of this website is available only to authorized representatives of current Kenmore Advisor Ltd. client firms. Access credentials are issued by Nathan Brulé during client onboarding as part of the standard statement of work development process.
A few straightforward rules govern portal access:
- Do not share credentials. Each set of login credentials is issued to a specific individual at the client firm. Sharing passwords with colleagues, associates, or third parties — no matter how trusted — is prohibited. If additional team members require access, Nathan can issue separate credentials promptly.
- Report suspected unauthorized access immediately. If you believe someone has accessed the portal using your credentials without authorization, contact contact@kenadvisorcenter.com or call (510) 673-9926 without delay. Kenmore maintains disaster recovery frameworks and security incident response protocols aligned with securities industry standards.
- Portal content is confidential. The materials accessible through the portal — including Practice Health Scorecards, engagement deliverables, due diligence packages, term sheets, annual reports, prospectuses, and recalibration reports — are proprietary and subject to the confidentiality provisions of your engagement agreement.
Portal access is deactivated upon completion or termination of the consulting engagement, unless the client transitions to an ongoing recalibration partnership. Access deactivation is communicated in writing at least 30 days prior.
5. Limitation of Liability
Kenmore provides this website "as is." While the firm takes every reasonable step to ensure accuracy — including regular content reviews and updates — the website may contain errors, typographical mistakes, or information that has become outdated between review cycles.
Kenmore's total liability arising from your use of this website is limited to $100 CAD — because, honestly, the website is free to use and the real value lives in our consulting engagements. This limitation applies to all claims arising from use of the site, including but not limited to claims based on warranty, contract, tort, or any other legal theory, regardless of whether the firm has been advised of the possibility of such damages.
Specifically, Kenmore Advisor Ltd. disclaims liability for:
- Decisions made based on information found on this website without engaging the firm's consulting services directly
- Interruptions in website availability, whether planned or unplanned
- Third-party websites linked from this site — the firm includes external links occasionally for reference, but does not endorse or guarantee the content, security, or privacy practices of any third-party site
- Loss of data arising from use of the website, including the advisor portal, due to circumstances beyond the firm's reasonable control
This limitation does not apply to liability that cannot be excluded or limited under applicable Canadian law. The firm carries professional liability insurance and takes its obligations seriously — but a free website and a paid consulting engagement are, for liability purposes, very different things.
6. Indemnification
You agree to indemnify, defend, and hold harmless Kenmore Advisor Ltd., its officers, directors, employees, consultants, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses — including reasonable legal fees — arising from your violation of these terms, your misuse of the website, or your infringement of any intellectual property or other rights of any person or entity. This is standard legal boilerplate, but it's worth stating plainly: if your use of the website causes the firm to incur costs, you're responsible for those costs. The firm trusts this scenario is purely hypothetical.
7. Governing Law
These terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein. Any disputes arising from or related to these terms or your use of the website shall be subject to the exclusive jurisdiction of the courts located in the City of Edmonton, Alberta.
For those keeping score: Alberta law, Edmonton courts, Canadian federal framework. If that geographic specificity surprises you for a terms-of-service page, consider it further evidence that Kenmore does not copy-paste templates from American legal websites — a small detail that reveals a broader organizational habit of doing things properly.
8. Severability
If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect. In less formal language: if one clause doesn't hold up, the rest still applies. The firm does not believe in the "one bad apple" approach to legal agreements — the structure is designed to remain robust even if a specific provision is challenged.
9. Changes to These Terms
Kenmore may update these terms from time to time. The "last updated" date at the top tells you when. Continued use of the website after changes are posted constitutes acceptance of the revised terms — which is standard, but worth stating clearly.
Material changes — defined as changes that substantively affect your rights, obligations, or the scope of data collected — will be communicated to active client firms directly via email. For non-client visitors, the updated date serves as the notification mechanism. The firm commits to not making material changes without a reasonable notice period of at least 14 days before the new terms take effect.
10. Contact
Questions about these terms? The firm genuinely welcomes them — both because clarity matters and because nobody should agree to something they don't understand.
